DMCA Policy

Overview

KIVIO respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

This policy explains how to report copyright infringement and our procedures for responding to valid claims.

Reporting Copyright Infringement

If you believe that your copyrighted work has been used on AI Music Platform in a way that constitutes infringement, please submit a DMCA notice containing the following information:

Required Information for DMCA Notice

  1. Your contact information: Full name, mailing address, phone number, and email address.
  2. Identification of the copyrighted work claimed to have been infringed: Provide a description of the work, including registration number if applicable.
  3. Identification of the infringing material: Provide the URL(s) or specific location of the allegedly infringing content on our platform.
  4. Statement of good faith belief: A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
  6. Physical or electronic signature: A physical or electronic signature of the copyright owner or authorized representative.

How to Submit a Notice

Send your complete DMCA notice to our designated Copyright Agent:

Note: Email is the fastest method. We respond within 24-48 hours to valid notices.

Important: Submitting a false or fraudulent DMCA notice may result in legal liability under 17 U.S.C. § 512(f).

Our Response Process

Upon receiving a valid DMCA notice, we will:

  1. Acknowledge receipt within 24-48 hours
  2. Remove or disable access to the allegedly infringing material promptly
  3. Notify the uploader that their content has been removed due to a copyright claim
  4. Provide the DMCA notice to the uploader (personal contact information may be redacted)

The uploader will have the opportunity to submit a counter-notice if they believe the removal was in error.

Counter-Notice (For Users Whose Content Was Removed)

If you believe your content was removed in error or due to misidentification, you may submit a counter-notice containing:

Required Information for Counter-Notice

  1. Your contact information: Full name, mailing address, phone number, and email.
  2. Identification of the removed content and its location: Describe the content and where it appeared before removal.
  3. Statement under penalty of perjury: A statement that you have a good faith belief that the material was removed due to mistake or misidentification.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the U.S., any judicial district in which AI Music Platform may be found.
  5. Physical or electronic signature: Your signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If they do not file a court action within 10 business days, we may restore the removed content.

Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy for the termination of accounts belonging to repeat copyright infringers.

Strike System:

  • 1st Strike: Content removed, warning issued
  • 2nd Strike: Temporary account suspension (7 days)
  • 3rd Strike: Permanent account termination

Strikes may be removed if a valid counter-notice is accepted or if the claimant withdraws their complaint.

Safe Harbor Provisions

KIVIO qualifies for DMCA safe harbor protection under 17 U.S.C. § 512(c) as a service provider hosting user-generated content.

We do not have actual knowledge of infringing activity until properly notified. We do not derive financial benefit directly from infringing activity. We respond expeditiously to valid DMCA notices.

False Claims & Penalties

Submitting a knowingly false DMCA notice or counter-notice is a violation of federal law.

Under 17 U.S.C. § 512(f), anyone who materially misrepresents that content is infringing (or was removed by mistake) may be liable for damages, including costs and attorney's fees.

We reserve the right to seek damages from anyone who submits a fraudulent DMCA claim.
